These terms cover your use of Encore: the Encore Wave app for iPhone and iPad, the Encore web app, and this website. Encore is made and sold by Noah Levine (trading as Encore Wave), an individual developer in New York, USA ("I", "me"). By using Encore or buying Encore Pro, you agree to these terms. If you don't agree, please don't use Encore.
Encore is a lyrics, chords and setlist app for performing musicians. You can use it free, with a limit on how many songs and setlists you can add. Encore Pro is a one-time purchase that removes those limits and adds the features listed on the pricing section. It is not a subscription. There is no recurring charge.
To buy Encore Pro, you must be old enough to make a purchase where you live, or have a parent's or guardian's permission.
In the iPhone and iPad app. Encore Pro is sold as an in-app purchase through Apple's App Store. Apple processes that payment, and the purchase is also covered by Apple's Media Services Terms and Conditions. Apple's standard Licensed Application End User License Agreement also applies to the app. Apple handles refunds for App Store purchases (see the Refund Policy).
On the web. Where web purchase is offered, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders. Paddle provides all customer service inquiries and handles returns for those orders. Paddle's own buyer terms also apply to web purchases.
Refunds. Web purchases can be refunded within 14 days of purchase. App Store purchases are refunded by Apple. Details are in the Refund Policy.
Prices. Prices are shown before you buy. I may change prices, run limited-time offers (like the founding price at launch), or end an offer. A price change never affects something you've already bought.
You own what you put into Encore. Your library lives on your device and, if you choose, in your own Google Drive. I don't claim any rights to it.
You are responsible for having the right to use the lyrics and charts you import, store and share. When you host a live session or share a setlist code, you let Encore send that content to the people you share it with, only so the feature works. Shared setlists are deleted automatically after 90 days.
Please don't:
I may remove shared content or block sharing for anyone who breaks these rules. If you believe something shared through Encore infringes your copyright, see Copyright / DMCA.
Encore stores your library on your device by default. Deleting the app, clearing browser data or losing a phone can delete songs that weren't synced or backed up. Use Google Drive sync or export a backup file. Here's how.
I keep improving Encore, so features may change. I may also stop offering a feature, a platform or the service as a whole. If I ever shut Encore down, I'll give reasonable notice where I can, and the app will keep working with the library on your device.
Encore is provided "as is" and "as available." I work hard to make it reliable on stage, but I can't promise it will be error-free or uninterrupted, or that data will never be lost. To the fullest extent the law allows, I disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, I'm not liable for indirect, incidental, special or consequential damages, or for lost data, lost gigs or lost income, arising from your use of Encore. My total liability for any claim is limited to the amount you paid for Encore in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection law that can't be waived.
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules, except where your local consumer law says otherwise.
If these terms change, the "Last updated" date above will change with them. Material changes will be posted here before they take effect. Continuing to use Encore after a change means you accept the updated terms.
